under what circumstances can the governor of a state exercise the following a) issuing ordinace b) Discretionary C) president's rule
 

Dear Student,


  The Governor is a constitutional head of the state who is the appointed by the President. He is the central nominee he is answerable to the Centre for upholding the constitutional sanctity of the state.


Ordinance making power:


The Governor can also pass an ordinance when the State legislature is not in session.  However, It needs to be approved by the state legislature when it reassemble.


A governor may use his Discretionary  power:

a. If the government loses majority in the Vidhan Sabha, then the Governor of the state may call another party to prove its majority on the floor of the house. The governor may dissolve the Vidhan Sabha and calls for elections.

b. In the state legislative assembly, Governor if the state has the power to nominate one member from the Anglo Indian community to the Vidhan Sabha if the/she feels that community has not been adequately represented.

c. The Governor can also reserve bill for President's consideration.

d. Further, he may also refuse to sign  an ordinary bill passed by the state legislature.

President Rule:


a.
Governor  can report to the Centre with regard to constitutional breakdown of the state machinery that is the state fails to function as per the constitution.
b. President rule is an emergency provision under Article 356 of the constitution in which if there is a breakdown of state machinery , that state comes under direct control of the Central government.
c. The state assembly is suspended .The Governor who is the central nominee exercises executive power. The authority shifts from the Chief Minister to the Governor of the state
